What is the legal value of native electronic documents (that do not require signature by the parties)?


The majority of legislation generally recognizes the validity and probative value of documents that are natively electronic (i.e., created as electronic originals), subject to compliance requirements.


Natively electronic records that don't require a signature are generally allowed in Portugal and satisfy the legal requirement of “in writing” when the document can be represented as a written statement. The validity of natively electronic documents in Portugal would be determined by a judge on a case-by-case basis. Follow general electronic recordkeeping best practices.
